From the Family and Supporters of Prisoner of Conscience Dr. Ayman Nour to All Those Who Have A Free Conscience

A few days ago over 110 parliament members representing the will of Egypt and all political trends, including the ruling party itself, submitted a signed memorandum requesting President Mubarak to use his constitutional right as stated in Article 149 to release Dr. Ayman Nour after having spent a year in prison and before the first year anniversary of the presidential election which took place in September 2005 where Nour came in second in terms of votes after which he was imprisoned in a case the meaning and naïveté of which were clear.

 المشروع يلغي مادة واحدة فقط من 18 مادة طلب الصحفيون إلغاءها.. ويلغي مادتين حكمت المحكمة الدستورية ببطلانهما.. ومادة تتعلق بتجريم مهاجمة النظام الاشتراكي وتحالف قوة الشعب العامل من بين أكثر من ثلاثين مادة تقضي بالحبس.. لم يلغ المشروع هذا الحبس سوي في أربعة مواضع فقط هي العيب في حق السفراء وسب الموظف العام والقذف في حق الأفراد أو الموظفين العموميين والسب علي إطلاقه.

"The Special Rapporteur on the independence of judges and lawyers, Leandro Despouy, the Special Representative of the Secretary-General on Human Rights Defenders, Hina Jilani, and the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, Ambeyi Ligabo, today expressed grave concern over recent attacks against the judiciary in Egypt and the severe repression of demonstrations organized by civil society in support of the judiciary. C

The independent experts are gravely worried that this decision represents a means to punish Judge al-Batawissi for exercising his right to freedom of expression with regards to the allegations of widespread electoral fraud during the parliamentary elections of 2005 and deter other judges from further action in favor of judicial reform.

The experts note the concerns expressed by a number of Egyptian judges at provisions included in the proposed Judicial Authority Law which reportedly may undermine the independence of the judiciary by providing the Minister of Justice power to determine the composition of the Supreme Judicial Council, to appoint the Head of the Court of Cassation and to decide the budget. Such control of the Supreme Judicial Council allows the Minister to influence that body's decisions on the appointment, promotion, transfer and discipline of all judges. The experts note that Judicial Authority Law will be submitted to the Parliament this week and call on the Government to ensure that the judges' proposals are taken into consideration and sufficient time is given to members of Parliament to appropriately consider their views.

The disciplinary decision of the Government, the proposed Judicial Authority Law and the violent attacks on peaceful demonstrators constitute interference with the independence of the judiciary and a violation of the freedom of opinion and expression and right to protest guaranteed by relevant international human rights instruments, in particular the International Covenant on Civil and Political Rights, the 1998 Declaration on Human Rights Defenders and the Basic Principles on the Independence of the Judiciary, which guarantee these rights to judges, human rights defenders and journalists.

Sharqawi’s ordeal continues…

Youth for Change activist, Mohamed el-Sharqawi sent a new letter from Mahkoum Tora Prison, cell no. 1-B, dated 12 June, complaining of medical negligence. The State Security Prosecutor had decided earlier last week to allow him treatment at El-Manyal University Hospital outside prison. Apparently this all turned out to be a farce. Here are excerpts from Sharqawi’s letter:

have been an employee of WorleyParsons Komex since January of this year. I have served as a field ecologist with the Cairo office. On April 24, I was detained by the Egyptian State Security police, and held for 33 days without appearing before a judge, and obviously without being convicted of any crime.
